Brian Rosenthal
He represents clients at the Arkansas Department of Energy and Environment’s Division of Environmental Quality as well as the United States Environmental Protection Agency (EPA) in multiple regions to negotiate compliance with relevant laws and regulations governing industry. We also defend legal actions brought by those agencies and represent entities and groups in environmental litigation.
Brian is a past chair of the Arkansas Bar Association’s Environmental Law Section and a founding fellow and current member of the American College of Environmental Law.
Brian assists in analysis and review to provide proper contractual protections through indemnities and prosecute their enforcement when necessary. He has successfully obtained, and managed insurance protection for clients and managed insurance claims.
He provides review of all environmental matters in business transactions, from review of due diligence issues such as permitting and compliance to drafting appropriate indemnity and contractual agreements regarding past and prospective environmental matters. Brian assists and facilitates redevelopment efforts and the return to productive use of industrial property through Brownfields laws and voluntary clean-up programs and has successfully entered properties into Brownfields programs in multiple states (including the first ever completed in Arkansas).
