[0] => Governor Nelson Rockefeller had New York build this stretch of Route 117 in order to have ready access from his estate, Kykuit, access to the Tappan Zee Bridge, without the congestion of local traffic southbound in the Village of North Tarrytown and Tarrytown on the Albany Post Road (Route 9, Broadway). Local environmentalists and the Village of Tarrytown hired David Sive, Esq., a leader of the Sierra Club in New York (later recognized as the father of environmental litigation nationally), to sue Governor Rockefeller to block his proposed highway in the Hudson. The plaintiffs won the case in the federal court in Manhattan. David Sive hired me, then a summer associate after my second year at Columbia Law School, to work on appeals of this case. The Court of Appeals affirmed the ban on the new highway. In Citizens Committee for the Hudson Valley v. Volpe, 302 F. Supp. 1083, 1089 (S.D.N.Y.1969), aff'd., 425 F.2d 97 (2d Cir. 1970) available at httpscasetext.comcasecitizens-committee-for-the-hudson-valley-v-volpe , the court held that only Congress could permit a dike in a navigable river, not the State of New York or the Army Corps of Engineers. Had Governor Rockefeller won, the Route 177 expressway would have transformed the site where Rockwood Hall State Park exists today, and the viewshed, into a highly visible transportation corridor.
